REQUIRED EXPLANATION OF REQUEST
  The Attorney General's Office respectfully requests Controlling Board approval to waive competitive selection in the amount of $140,490.00 from Fund 3E50, ALI 055638 (Attorney General Pass-Through Funds) to contract with Optimum Technology Inc. of Columbus, Ohio (Franklin County) to develop enhancements to the Web Records Management System module of the Attorney General's Ohio Law Enforcement Gateway (OHLEG) to collect and report use of force data.  
  On June 3, 2015, the Criminal Justice Information Services Advisory Policy Board of the Federal Bureau of Investigation (FBI) recommended the FBI develop new data collection on fatal and nonfatal officer-involved shootings. Later that year, representatives from major law enforcement organizations met and proposed an expansion to the FBI's efforts to include use of force data collection and on February 9, 2016, the FBI director signed the recommendations of the Advisory Policy Board. Since then, the National Use-of-Force Collection Task Force, comprised of law enforcement leaders from across the United States, convened for a series of meetings to discuss use of force data collection details.      

The FBI utilizes the National Incident-Based Reporting System (NIBRS) to collect incident-based data. The Federal NIBRS requirements were developed not only as a reporting standard, but also as a model from which state uniform crime reporting programs could work to develop their own incident-based reporting systems. In 2017, the Office of Criminal Justice Services as well as the Ohio Department of Public Safety established data collection guidelines for reporting use of force incidents though Ohio's Incident-Based Reporting program using the FBI's national use of force data collection program as the foundation. As a result, several record management systems (RMS) across the Ohio including the Ohio Law Enforcement Gateway (OHLEG) will need technical upgrades in order to collect the use of force data. To fund these upgrades, the Office of Criminal Justice Services received a federal grant from the Department of Justice and determined the Ohio Attorney General's Office to be best suited to administer the Use of Force Software Update funds for OHLEG RMS users. Updating the RMS utilized in OHLEG will allow 239 Ohio law enforcement agencies the ability to electrically report applicable use of force data.

This contract will be 100% funded via a federal grant.

Optimum Technology Inc. has a state term contract with the Ohio Department of Administrative Services and is the current maintenance supplier for the Ohio Law Enforcement Gateway Search Engine as well as the Records Management System (RMS) suite of applications. Since Optimum Technology Inc. is the current supplier, OCJS selected them to provide enhancements to the RMS module in an effort to meet the new Department of Justice Use of Force data collection specifications.
