REQUIRED EXPLANATION OF REQUEST
  The Department of Administrative Services respectfully requests Controlling Board approval for an agency-released competitive opportunity in the amount of $375,000 from Fund 1300, ALI 100606 (Risk Investment Reserve), in FY 2021, to renew the contract with Montgomery Jonson, LLP, Cincinnati, Hamilton County, to provide insurance defense counsel for the Ohio Judges' Professional Liability Self-Insurance Program.  
  Montgomery Jonson, LLP will serve as insurance defense counsel to the judges of all municipal and common pleas courts and private and retired assigned judges located in counties that comprise Ohio Appellate Districts 1, 2, 3, 4, 6, 7, 8, 9, 11 and 12 covered by the Judges' Professional Liability Self-Insurance program, a self-insured program operated by DAS according to Section 9.82 of the Ohio Revised Code.

Montgomery Jonson, LLP is also responsible for providing an attorney-staffed Judicial Hotline program for judges located in counties that comprise Ohio Appellate Districts 1, 2, 3, 4, 6, 7, 8, 9, 11 and 12 which provides limited advice and counsel to the insured judges and their administrative staff in pre-litigation matters, with the objective of reducing the likelihood of liability and the future expenditure of insurance funds.

DAS first assumed responsibility for the Ohio Judge's Professional Liability self-insurance program in FY 2017 at the request of the Ohio Supreme Court. At that time, we conducted an agency-released competitive opportunity, selected the current provider, and obtained Controlling Board approval (DAS0100868). The Controlling Board approved an amendment to this contract for 2017 on 4/10/2017 (DAS0100899). On 6/12/2017, the Controlling Board approved the renewal of this contract for the FY 2018-2019 biennium (DAS0100917). On 4/10/2019, the Controlling Board approved a Non-Substantive Change (DAS0100923) for a change to the supplier name from Montgomery, Rennie & Jonson LPA to Montgomery Jonson LLP. On 06/10/2019, the Controlling Board approved the renewal of this contract for FY 2020 (DAS0101055), and DAS now requests approval to renew this contract for one additional fiscal year, FY 2021.

DAS recently received proposals per a new Request for Proposals (RFP) to provide these services in the future. However, due to time constraints, we are requesting to extend the current contract into FY 2021. Once a new contract is awarded, this contract may be terminated without cause. It is our goal to review the new proposals and award new contracts by the second quarter of FY 2021.

The program provides coverage in personal capacity and combined personal and official capacity claims for professional liability and employment practices liability and limited coverage through the probable cause stage of disciplinary proceedings initiated under the Rules for the Government of the Bar, Rule V.
