REQUIRED EXPLANATION OF REQUEST
  The Department of Natural Resources respectfully requests Controlling Board approval to waive competitive selection in the amount of $82,500.00 in FY 2021 from Fund 2230, ALI 725665 (Law Enforcement Administration), to contract with Motorola Solutions, Inc., to provide a field maintenance service agreement for continued service, maintenance support and subscriber services for our law enforcement and regulatory fleet in the field throughout the entire State of Ohio.  
  The State of Ohio is the owner of a complex, mission critical communication system that was designed by and purchased from Motorola. The Department of Natural Resources (ODNR) owns a significant number of fleet vehicles equipped with Motorola manufactured radios operating on the MARCS system, which are maintained and serviced by Motorola and its authorized service shops. The Motorola Astro and Data subscriber equipment used on the MARCS system have several features that are proprietary in nature and unique in design. Continuance of service with Motorola will ensure that our communications system will operate at optimal levels during normal and mission critical events.

The Motorola dealers provide factory trained service personnel and factory authorized replacement parts and radio components at a cost effective price statewide in all 88 counties. Motorola will provide field technicians through the entire State of Ohio. ODNR has staff and/or facilities in all 88 Ohio counties. Radio service and maintenance by the vendors includes programming, troubleshooting and diagnostic evaluation of radio problems, transmit and receive frequency verification and adjustments if required. Software and replacement parts and components are proprietary to Motorola. Maintaining and servicing ODNR purchased MARCS radio system voice and data equipment cannot be performed by agency staff. Services provided by the vendor are at a fixed contract cost with no limit on the number of services calls provided to ODNR.
