REQUIRED EXPLANATION OF REQUEST
  The Department of Natural Resources respectfully requests Controlling Board approval to release capital funds in the amount of $518,350.00 from Fund 7031, ALI C725M0 (Dam Rehabilitation), in FY20, for the design and construction of operationally essential, incremental, or urgent improvements to ODNR dams, impoundments and other water resource structures and related appurtenances at facilities statewide. Additionally, the Department of Natural Resources also respectfully requests Controlling Board approval to release capital funds in the amount of $260,000 from Fund 7015, ALI C725L9 (Dam Rehabilitation) for an agency released competitive opportunity to amend contracts with Gannett Fleming Engineers and Architects, P.C., Columbus, OH, and Tetra Tech, Inc., Gahanna, OH, to provide investigative, design and construction administration services necessary for dam investigation and rehabilitation projects at ODNR Division of Wildlife facilities statewide.  
  ODNR is responsible for the management of a total of 116 regulated dams, with 56 of these dams identified as Class I or "high hazard potential" due to the height of the dam, size of the impoundment they create and the potential threat to downstream persons and property should they fail. In addition to regulated structures, ODNR maintains many water resource structures such as conservation ponds, shoreline embankments, and related structures. While design and construction of rehabilitation projects is a high priority for capital appropriations, a need has been identified to also complete smaller incremental, urgent, critical or operationally essential improvement projects at ODNR owned structures that address specific issues including but not limited to damaged or inoperable lake drain systems, insufficient erosion control measures, minor spillway concrete replacement, installation of supplemental drainage piping, and upgrades to access ladders, bridges, and other systems.

This request will replenish a specific source of funding for such improvement projects by the ODNR Division of Parks and Watercraft, the ODNR Division of Wildlife, and the ODNR Division of Forestry with assistance from the ODNR Division of Engineering. All projects will be competitively bid in accordance with State of Ohio laws and rules. All contractors shall meet EDGE certification requirements.

In addition, these funds may be used to address emergency improvements in declared exigency situations. Costs associated with emergency response actions required at ODNR dams such as: a) consultant services, i.e., engineering design, assessment, permit acquisition, underwater investigations, etc., b) equipment rentals, i.e. pump/siphons, boom lifts, tractors, bulldozers, etc., c) contract work i.e. concrete installation/repair, grouting, metal fabrication, etc., and d) material acquisition, i.e., bentonite, gravel, stone may be included.

ODNR desires to amend these professional engineering services contracts so that the consulting engineers can continue to provide urgent and or emergency technical assistance through the end of the two-year period envisioned for these services. Professional engineering services are necessary in order to provide short-notice, urgent and/or emergency technical assistance, including assessments, design services, construction documents, and construction administration for minor rehabilitation of selected ODNR Division of Wildlife-owned dams, shoreline embankments, canal-ways, and other water resource structures and their related appurtenances. The amended contracts will allow ODNR to assign and engage the professional engineering services in order to complete Division of Wildlife dam improvement and water resource related projects already identified and initiated within the existing contracts. These amendments utilize funding made available through Division of Wildlife funding to complete work for Division of Wildlife projects.

Gannett Fleming Engineers and Architects, P.C. has proposed a 15% EDGE participation through 2LMN, Inc., CTL Engineering, Inc. and Lawhon and Associates. Tetra Tech, Inc. has proposed a 15% EDGE participation through Smart Services, Inc. and Kramb Consulting, LLC.
