REQUIRED EXPLANATION OF REQUEST
  The Environmental Review Appeals Commission respectfully requests Controlling Board approval to waive competitive selection in the amount of $10,000.00 from fund, GRF, ALI 172321, Operating Expenses, in FY18 to contract with Dayhuff Group LLC for a maintenance service agreement for ERAC/EBR's electronic filing system.  
  Dayhuff Group LLC designed and implemented ERAC/EBR's electronic filing and case docketing system in 2015. The project was completed in 2015 and has been in use since January 2016.

ERAC/EBR seeks to renew a maintenance agreement with Dayhuff Group LLC, which establishes an hourly rate of $143.55 for any required support (up to 100 hours). The agreement covers only as-needed support and thus does not impose any minimum expenditure requirement if no support is ultimately required.

ERAC/EBR did not competitively bid this contract because Dayhuff Group LLC is a singe-source provider. Dayhuff Group LLC created the initial implementation and is thus intimately familiar with the design and installation of the system.
