REQUIRED EXPLANATION OF REQUEST
  The Ohio Facilities Construction Commission (OFCC) respectfully requests Controlling Board approval for an agency released competitive opportunity in the amount of $250,000.00 for FY 2021 to contract with various enhanced commissioning agent firms to ensure constructed building systems meet operational design specifications and perform interactively in accordance with contract documents and owner objectives. This includes an extension of a previous Controlling Board approved agency released competitive opportunity for two contracts in which work is not anticipated to be complete by June 30, 2020.  
  OFCC must provide specialized construction management services for projects on a continual basis. To address these situations, OFCC has used the Request for Qualifications (RFQ) (Attachment A) process to select and pre-approve a pool of consultants for Enhanced Commissioning Agent services on an as-needed basis.This pre-qualified list of commission service consultants allows project teams to select qualified vendors without the need to separately develop, publish, and procure these services for each project avoiding duplicate processes and extension of the procurement timeline by approximately 2 months.

Commissioning Services are professional services typically performed by licensed engineers or architects. The purpose of these services is to maximize the energy efficiency of the HVAC, plumbing and electrical systems and to test/verify that the installed systems operate as intended. OFCC has created a list of pre-qualified consultants to perform Commissioning Services on our capital projects serving K-12 school districts, state agencies, and institutions of higher education. The current list of pre-qualified consultants expires June 30, 2020. This request is to approve a new list of pre-qualified consultants available to support ongoing and new capital project activity from July 1, 2020 through June 30, 2021.

For each specific project that requires Enhanced Commissioning Agent services, the following procedures will be used:
    1. For projects with an estimated Enhanced Commissioning Agent fee of more than $100,000, unless the Director of OFCC declares an emergency, OFCC shall issue an announcement of projects stating the specific services required, to a minimum of three firms in the pre-qualified list of seven firms. For projects less than $100,000 OFCC may request a fee proposal from a single firm, pursuant to Section 153.691 of the Revised Code.
    2. OFCC shall select the firm it considers to be most qualified based on the type of services required for the project, the ranking of the firm when selected for the pre-qualified list of consultants, and the location of the firm. The Project Manager shall then negotiate a contract with the firm determined to be most qualified.

Each firm will be limited to a cumulative maximum amount of $250,000 in contract work over the biennium unless otherwise authorized as an emergency by the Controlling Board President. OFCC shall request approval from the Controlling Board for all funds exceeding the aforementioned amounts.
